Court Reaches Decision on Janet Jackson Nipplegate Case

You would think that the infamous Nipplegate scandal, which starred Janet Jackson’s nipple during the Superbowl 2004 half-time show, would be over by now, but, it seems that CBS wanted to contest the $550,000 indecency fine imposed by the Federal Communications Commission.

E! reports that CBS can heave a sigh of relief because it has achieved a landmark case with the 3rd U.S. Circuit Court of Appeals dismissing the Federal Communications Commission fine as “capricious,” and the incident as not fulfilling the definition of indecent programming; consequently, TV network CBS is not liable for the breast exposure.

Furthermore, the court’s decision was supported by the facts that Janet Jackson and Justin Timberlake are not CBS staffers, thus, releasing CBS from any liability for the singers’ actions.
